YNET: ‘Stop-and-frisk’ bill gets final approval

Knesset passes bill permitting police to conduct body searches with probable cause; wording softened from previous version, but some fear that minorities will be unfairly targeted.

A Knesset plenum approved on Monday night the “stop-and-frisk law” proposed by Public Security Minister Gilad Erdan, which expands law enforcement’s authority to conduct searches. The law permits police officers to search someone’s body and belongings if there is a reasonable suspicion that he may be about to commit violence, or in the event that he uses threatening or violent language.

The bill permits police to search anyone in a group believed to be suspicious. Police will only be able to conduct weapons searches in certain places in accordance with the law, or in the event that there reasonable suspicion of someone carrying a weapon.

Furthermore, the law will allow the chief of a police district to designate a location in which there is suspicion of terrorist activity as a location where body searches are permitted in order to locate illegal weapons. This declaration would remain in effect temporarily and would be the result of heightened security.

The bill is essentially a softened version of the original, which was formulated by the Public Security Ministry and encountered widespread public opposition, including by the Association for Civil Rights in Israel.

Attorney Avner Pinchuck, director of the association’s Civil and Political Rights Unit, said the bill originally allowed body searches without probable cause, “but the approved version threatens citizens no less.” Pinchuk argued that Ethiopian Israelis, Arabs, and darker-skinned Jews will remain vulnerable to harassment without any oversight. Indeed, the bill has raised fears of discrimination among Ethiopian Israelis and Arabs.

Minister Erdan, for his part, said passage of the law constitutes “an important boost to the police’s ability to more effectively fight terrorism and violence.”

The highlighted words and phrases above are all relative, if not completely subjective, the definitions of which will be selectively decided upon by the pawns of the Erev Rav controlled government.

This bill is the classic of governments worldwide, a response to terrorist attacks and other acts of violence. Governments use these events as excuses But, the ultimate goal is increased control over the populace. In Israel’s case, this contributes to the ultimate goal of shaping the country.

While the left has decried that this will be selectively enforced against Arabs. I believe that, in fact, the end result will quite the opposite. The targeting of those “settlers” and Haredim, who dare to hold Torah in a place of authority over the State, will be much easier now. The secular youth fed up with Arabs’ seduction and assault on our sisters, will be more easily “dealt with.”

The application of this law to the only real threat to our physically safety, the Arabs, will be seen by the public only minimally, just enough to keep the wool pulled over our eyes, maintaining our belief that this law is “for our own good.”

The Israeli Government is not nearly as concerned with the Arab threat, as it is with what it believes to be the existential threat to the State. Anyone who disagrees with its vision and direction for the Jewish People, assimilation into the global community of goyim, is high on its priority list.

And what about the rights of citizens based on the State’s own claim of being a democracy? In other words, expect the government to show us more examples of how it repeatedly breaks its own rules.

A friend of mine was once stripped naked in the middle of a group of female border patrol officers. Were his religious rights respected? No, they were not. And, yes, there are such a things. At least there are supposed to be.

We have also heard allegations of these rights of young religious women being violated in the Tirza prison, having been forced to appear in states of undress in front of male officers. However, reactions to these allegations by feminists and women’s rights advocates have conspicuously absent.

Enter additional proposed laws, the revocation of residency status of terrorists’ families, and/or the blowing up of their homes.

Not so long ago, a friend of mine was acquitted of “incitement to racism.” He was brought to trial for daring to suggest that we consider removing hostile (not all, but only hostile) Arabs from Azza (Gaza).

The so-called “right-wing” will undoubtedly being celebrating over these proposed laws. But, what happens when their children are labeled as terrorists, or even just suspected of violence or incitement? What happens when their own children become, or become confused with, the very hilltop youth they themselves make a hobby of demonizing?

Their tunes may change, but it will be too late.

במקדש – האבנט לבדו היה עשוי ‘מעשה רוקם’, כלומר היתה צורה מצמר שרקומה על האבנט מצד אחד ואיננה נראית מהצד השני של האבנט (רמב”ם כלי מקדש ח,טו;ח,א). ואין צורת הצורה מעכבת (יריעות שלמה כלי מקדש ח,טו).

רשימה לפרשת משפטים

מעמד הר סיני מוקף משני צדדיו בהלכות ש”בין אדם לחברו”: בתחילת פרשת יתרו, “ושפטו את העם בכל עת”, ובפרשת משפטים שלפנינו.

מדרש רבה ממשיל זאת למטרונה שהיתה מהלכת, ומלפניה ומאחוריה הולכים שומרי הראש, אנשים חמושים בכלי זין. “כך התורה דינין מלפניה ודינין מאחריה והיא באמצע” (פרשה ל, פסקה ג).

אפשר ללמוד מכאן על חשיבות היושר וההגינות ביחסים בין בני אדם.

שח לי חסיד גור הרב הרשל מורגנשטרן זצ”ל, מייסד מכון ” אוצרות גאוני פולין”. פעם בא חסיד לאדמו”ר “בית ישראל” מגור וסיפר בשבחו של פלוני, שהוא צדיק וירא שמים מרבים. הרבי שאל אותו קצרות: זאת מניין לך, האם היה לך עסק (ממוני) איתו? כלומר יראת שמים נמדדת במבחן הכסף. קנה המידה ליראת שמים זו הגינות עסקית !

בהקשר זה אני מבקש להציג את המסמך הבא.

מצאתי אותו על דלפק הספריה לפני כשנה ואינני יודע מי הניחו שם.

בסך הכל זהו דף נייר פשוט, שכנראה היה תלוי על מזוזת פתח אחד הכוללים או על לוח מודעות סמוך.

במודעה, ראש הכולל גוער בתלמידיו על הנוכחות שלהם ב”כולל” ועל הזלזול בשעות הלימוד. הכאב ניכר מקירות ליבו של הכותב וניסוח הדברים חד וחריף.

וכך במציאות המרה בתקופתנו, אם יש דבר כלשהו לסדר. עושים חשבון ודאי בזמן הפנוי מחוץ לסדר הלימוד בכולל א”א [אי אפשר] להקדיש כי צריך לעזור לאשה, ע”ח [על חשבון] המנוחה א'”א כי הגוף יתעייף והוא לא יהיו מוכשר לדבר בזמן הסדר, על חשבון האוכל ודאי א'”א. אבל כן ישנו סדר של ד’ שעות, אמנם שעה וחצי לסרוגין הולכים בשה”י פה”י [בשבת היום, פסח היום]. אבל בכל זאת נותרו שעתיים וחצי, וזמן זה של למוד התורה, הגוף מתעייף, ניתן לסדר את העסק ע”ח הלמוד כי זה חיוני לפי עצתו של היצר. וזה שאמרו חז”ל עוסק אדם בכל עניני העוה”ז [העולם הזה] מדבר דברים ולא מתעייף, קם ללמוד קם להתפלל ומתעייף]

Moshiach is definitely on the way.

Sure, we all talk about Geula, the ingathering of the exiles, and the rebuilding of our Holy Temple, speedily and in our days, Amen. We’re commanded to eagerly await Moshiach and to expect salvation at any moment. But do we?

I can honestly say today that I can feel the intimate arrival of Moshiach and the rebuilding of the Bet HaMikdash; that is, ever since I accompanied Rabbi Lazer Brody on a trip to the village of Shilo, about an hour north of Jerusalem in the Binyamin Region, the site of the Holy Tabernacle that was destroyed during the Philistine Wars during the time of Eli the High Priest.

For those who may not know, Rabbi Lazer plays wood flutes and composes melodies for them. His first album, Calming Waters, has received wonderful reviews both in Israel and in the USA. But, despite the fact that he largely uses the NAF (Native-American flute), what people know as the “Indian Flute,” Rabbi Lazer doesn’t try to adapt himself to any conventional style, especially foreign. “Rebbe Nachman demanded that we be upright menagnim.”

“Menagnim”- literally “melodists” – is the Hebrew word for musicians. Musicians play instruments, but melodists sing songs of praise to Hashem. Rabbi Lazer adds, “Rebbe Nachman didn’t want his disciples to be bar-room musicians. He wanted us to be menagnim. You’ll find that in the first section of Likutei Moharan, Torah 3. Yet in Torah 54, the Rebbe says that the instrument must be upright as well, capable of being a worthy vessel for the niggun, or melody. For that reason, I always dreamed of having a flute that would be made of local Israel-grown wood and crafted here by an upright Shabbat-observing and G-d fearing craftsman. In short, I was looking for something spiritually pure as possible that would give me the tone of the flute used in the Bet Hamikdash, our Holy Temple. I asked Hashem to give me such a gift…”

Sounds like a pipedream? Those with emuna ask Hashem for whatever they need. Well, Hashem certainly heard Rabbi Lazer’s prayers. “After Calming Waters hit the market, I received an email from an individual in Shilo by the name of Joe Bazer. He happened to be an acclaimed master wood turner who had now begun to make his own flutes, right here in the Land of Israel. We met in Jerusalem, and we became great friends. Joe made a custom Eucalyptus flute for me in G; it sounds like a nightingale and is just as good as the American-made NAF. But, it still lacked the tone of the Bet HaMikdash.”

The faster Moshiach and Geula approach us, the more we see outright revelations of G-dliness in this world. Rebbe Nachman said that for those who believe, miracles are the course of nature. Rabbi Lazer pulled a Gemara off the shelf and opened it to tractate Arachin, second chapter. “Look here, Tal,” he showed me. “The Mishna here describes the type of flute that was used in our Holy Temple. It was made of native Israeli River Cane, not bamboo or metal. The Gemara explains that Israeli River Cane gives the flute a specially sweet and desirable tone. This flute is so important that it is played on the days when the entire Hallel is said, even if the day lands on a Shabbat! When I first learned this in deep detail, as soon as I closed the Gemara, I got a call from Joe Bazer. You’re not going to believe this…”

Joe called Rabbi Lazer with the good news that he had just completed his first 5-hole flutes made from Israeli River Cane. He calls this the “Shepherd flute” for undoubtedly, this was the type that King David played as a shepherd in the hills of Judea. Rabbi Lazer calls this the rebirth of the Judean flute. “Lucky I had a ride to Shilo when Joe called me,” smiles Rabbi Lazer. “Otherwise, I’d have put on my Nikes and run all the way from Ashdod to Shilo!”

Rabbi Lazer picked out 3 of the Shepherd Flutes as a start. What could be healthier for the soul? This is just what Rebbe Nachman wanted – a kosher menagen with a kosher instrument, playing original songs of praise to Hashem. Moshiach is undoubtedly fast on the way.

Joe and Daphne Bazer came to Israel from the USA twenty years ago. Joe’s phenomenal Shepherd’s Flute is now available online from his website Shilo Flutes. Pretty soon, the sweet strains of the Bet Hamikdash will be heard far and wide, amen!
