We Have to Follow the Sanhedrin…Right?

I’ve written extensively about how it can be that so many rabbis would get something wrong, and the responsibility we have to recognize when this happens. One does not need to be an “expert” to observe a fundamental error, even by someone with superior knowledge and credentials. Expertise merely grants the presumption of an opinion worth considering; it does not ensure against laziness, sloppiness, human error, ignorance of relevant information, or corruption. No one gets a blank check.

Nevertheless, some fearful Jews continue to deny their responsibility to recognize falsehood and break from authority figures who make erroneous pronouncements. “Don’t we have to listen to the Sanhedrin?” they argue. “The rabbis have ruled that we must follow the Ministry of Health recommendations. Case closed.”

Or is it? This week’s parsha begs to differ.

We learn of the various types of korbanos [sacrificial offerings] as part of the atonement process (they have no effect if they are not accompanied by actual repentance, a common failing in ancient times). There are special korbanos for three categories of leaders who sin: the Kohen Gadol, the king, and the Sanhedrin. Unlike other systems, which pay lip service to the fanciful notion that “we are all equal under the law” (LOL), the Torah has an openly inequal system. Those with greater power are held to a higher standard, for their sins lead others astray and cause more damage to the nation. Their korbanos are more severe, and a complete atonement for their sin cannot be guaranteed.

The Torah refers to the Sanhedrin as “כל עדת ישראל”, the entire assembly of Israel (4:13). They wield even greater power than the king and the Kohen Gadol, for they determine Jewish law for the entire nation. Their authority transcends the political power of the king and the spiritual supremacy of the Kohen Gadol. A king’s decrees are in force only during his reign; the Sanhedrin’s rulings outlive those who issued them.

If the Sanhedrin issues an erroneous ruling, and the masses sin because of it, they must bring a special korban, as outlined in the following pesukim. The masses who follow this ruling are exempt from bringing a korban, as they otherwise would. An entire tractate of Gemara, Horayos, is devoted to the halachos pertaining to this section. This section of the Torah and the teachings of Chazal shed great light on the times in which we are living, despite the absence of a Sanhedrin and korbanos.

  1. The possibility of the Sanhedrin getting something wrong is real, and the Torah takes it very seriously. The Torah gives no one a blank check, not even the greatest sages, not even a confirmed prophet. Those who argue that we have to blindly follow the so-called “leading rabbis” of today, who themselves are telling us to blindly follow so-called “leading experts”, are making a fundamental mistake. We don’t blindly follow anyone, certainly not when they tell us to blindly follow godless people with conflicts of interest and serious integrity issues. The Torah doesn’t write about this as a theoretical exercise. It’s practical Jewish law.
  2. Lower courts are pointedly excluded from these halachos. Only the Sanhedrin is liable to bring this special korban for an erroneous ruling (Horayos 5A). Not only are they not presumed to be infallible, they are singled out for the greatest accountability in the event of a mistake. This is clearly intended to warn us against blindly trusting those who deserve our trust more than anyone else.
  3. The entire Sanhedrin must be qualified to give rulings. If even one judge was unqualified, they do not have to bring the special korban (Horayos 4B).

Nowadays, there is no Sanhedrin and no facsimile thereof. The argument that we must blindly follow the declarations of so-called “leading rabbis”, who lack the authority of a Sanhedrin both individually and collectively, and whose qualifications to be judges on a future Sanhedrin are far from certain, is a non-starter. Nowadays one can find a rabbi, or a collection of rabbis, to sign off on virtually anything. Conferring Sanhedrin status on rulings today is an insult to the institution.

  1. Only the details of a mitzvah* *can be hidden from the eyes of the Sanhedrin, not the entire mitzvah. If the Sanhedrin rules to uproot an entire mitzvah, they do not bring the special korban (Horayos 4A).

It is noteworthy that Chazal entertained the possibility of a Sanhedrin being so ignorant or corrupt that they would rule to uproot an entire mitzvah. This is not science fiction or a “conspiracy theory”; it’s an actual Gemara, derived from a pasuk, that is consecrated in Jewish law. Furthermore, Chazal also discussed a situation in which the Sanhedrin ruled to permit avoda zara, or declared that one type of avoda zara is not actually forbidden, and this is also concretized in Jewish law.

Those who say it can’t happen or won’t happen are dismissing Jewish law and our greatest sages, who took this eventuality very seriously.

The Worth of Our Mitzvos

The Greatest Generation

 

The Chofetz Chaim[1] is bothered how Moshiach can come in such a time as ours when he didn’t come in previous generations where the gedolim were greater.

 

1. He writes that we shouldn’t wonder how we can merit that which even our predecessors could not merit. The truth is that even though we are much smaller spiritually than our ancestors, Hashem combines and consolidates our merits with those of the generations that preceded us.

 

This is likened to a scenario where a dwarf is carried on the shoulders of a giant. The giant, while towering and nearly reaching the ceiling, falls just short, as it Is just beyond his reach. However, when the dwarf is placed on the giant’s shoulders, suddenly, reaching the ceiling becomes achievable.

 

2. The following is another approach to this question. Although we recognize how impure and immoral the world is today, we cannot forget that this also showcases our greatness. This is because despite all the hardships and negative influences, we still serve Hashem.

 

The Ohr Lashamayim[2] (1767–1831) quotes from the sefer Bris Menucha regarding the statement im rishonim bnei malachim anu bnei anashim…, if the scholars of previous generations were sons of angels, then we are sons of men, if they were sons of men, we are like donkeys…[3] While this standard held true in their day, today, when there is so much darkness and yet we strengthen ourselves to serve Hashem according to our ability, we are considered greater than tzadikim from earlier generations!

 

Similarly, the Arizal (1534–1572) conveyed to R’ Chaim Vital that nowadays, in the darkness of exile, even a single heartfelt cry or a groan that comes from the depth of one’s heart holds a significance comparable to many fasts observed in earlier generations. The Yismach Yisrael[4] points out that this was in the time of the Arizal. Imagine what a sigh or groan from us today is considered, as the exile and troubles of today are much worse.[5]

 

Perhaps our lowly generation possesses the power to usher in Moshiach as we face insurmountable challenges and are incessantly bombarded with tests and temptations of an extreme nature.[6] By continuing to serve Hashem despite all the difficulties we face, we are truly exceptional. And we merit Moshiach more than any preceding generation. In a sense we are not mere dwarves standing on the shoulders of giants; rather we can be likened to the tallest of giants standing on the shoulders of the giants who came before us.

[6] The purpose of the neshamos of the last generation, the generation of Ikvisa Dimshicha, is for them to descend to the lowest places. This descent is intended so that when Hashem awakens them to teshuva, they will rectify all these low places. This leads to the advent of Moshiach (See the Arvei Nachal, Breishis, Drush 2).

סוגיית גיוס החרדים נוספה לסדר היום הציבורי לא במקרה דווקא בעיתוי הזה. אבל למרות חשיבותה הרבה, עוד קודם לה יש לבחון מהי מטרתם של ראשי צה”ל במלחמה, אילו ערכים ופרדיגמות חשיבה מובילים אותם, וכיצד יתחולל שינוי עומק אמיתי בשורות הנהגת הצבא. דעה

תארו לכם שאתם הולכים למכולת לקנות לילדים שלכם ארוחת בוקר, כדי שיגדלו ויהיו חזקים. כאשר אתם נכנסים למכולת, יש לפניכם רשימת מבצעים שמסיחים את דעתכם. אתם קונים את כל מה שבמבצע, חוץ ממה שלמענו באתם. כעת אתם חוזרים הביתה, והילדים שואלים: “איפה האוכל? אנחנו רעבים”.

אחד המושגים הכי חשובים בתקשורת המונים הוא: קביעת סדר יום. הנושאים שעולים בתקשורת לא בהכרח אומרים שהם הכי חשובים לציבור, אלא הם הכי חשובים לעורכי התקשורת ולאליטה שמממנת אותם. אנשים אלו יקבעו במה כולנו נתעסק.

כך למשל נוספה לאחרונה לסדר היום סוגיית ‘גיוס החרדים עכשיו!’, כנושא עיקרי שכולם צריכים לדבר עליו. שמא תאמרו: זה באמת נצרך עכשיו, חסר כוח אדם, ולא הגיוני שמגזר שלם ישתמט. אני מסכים לטענה שלא הגיוני שמגזר שלם ישתמט, במיוחד שלא כולם שם לומדים תורה, ובעיקר בזמן מלחמה. אבל בואו נבחן מה סדר העדיפויות האמיתי של המדינה והצבא בלי מניפולציות תקשורתיות ופוליטיות: בחג שמחת תורה האחרון נעשה טבח נוראי שלא היה כמוהו מאז השואה הארורה; הצבא בפרט ומערכת הביטחון בכלל לא היו ערוכים להגן על מדינת ישראל.

זה לא קרה בגלל שהסיטו כוחות לאיו”ש או כי החרדים לא גויסו, אלא בגלל פרדיגמות חשיבה משובשות שקיימות בתודעה של ראשי מערכת הביטחון, מה שמכונה “הקונספציה”. לפני הטבח הנוראי כל ראשי הצבא האחרונים דיברו על “צבא קטן וחכם”, סגרו חטיבות מילואים והכינו את צה”ל למודל צבא מקצועי, לא צבא העם. ממילא סוגיית גיוס החרדים לא עמדה על הפרק, במיוחד נוכח שילוב הלוחמות המואץ והעמדת ערך השוויון המגדרי כערך מוביל. שילובם היה פוגע בצביון החילוני של צה”ל, מי רוצה את כאב הראש הזה? שר הביטחון והרמטכ”ל, שמדברים בכל מקום על גיוס חרדים עכשיו, לא הכינו שום תוכניות. למי הם באים בטענות?

כמילואימניק שגויס, לדעתי סדר היום של האזרחים בכלל והמילואימניקים בפרט צריך להיות: הקמת ועדת חקירה ממלכתית עכשיו. ועדה שתבדוק מי האחראים למחדל הביטחוני, הדחתם המיידית והבאתם למשפט ציבורי. חלקם ככל הנראה יצטרכו לשבת בכלא, לא פחות מלוחם שמפקיר עמדה או נשק. במקום זאת האנשים האלו ממשיכים לקבוע סדרי עדיפויות, על פי אותן פרדיגמות חשיבה שאינן משתנות ביום אחד (משום שמדובר בפילוסופיה שלמה ומנומקת). הם ממשיכים לקבל ניירות עמדה ממכוני קונספציה, שולחים קצינים בכירים לקרנות חינוך שעבדו במשך עשרות שנים עם אוניברסיטאות אנטישמיות בארצות הברית, מקדמים קצינים בצלמם כדמותם ונותנים הערות פיקודיות למפקדים לוחמניים כדוגמת תת־אלוף ברק חירם. טבח נוראי ככל שיהיה לא משנה שיטה מדינית וצבאית, וזה שטחי לחשוב כך. גיוס חרדים חשוב, אך זהו תהליך, לא קמפיין של זבנג וגמרנו.

נוסף על כך, כשאומרים שחסר כוח אדם, השאלה שצריכה להישאל היא: כוח אדם לצורך מה? מה המטרות של ראשי צה”ל? למישהו יש מושג?

כשמשה רבנו מוכיח את בני גד ובני ראובן, “האחיכם יבואו למלחמה ואתם תשבו פה?”, הייתה לו מטרה ברורה מאוד, כמו שכתוב בפסוק: “ולמה תניאון את לב בני ישראל מעבור אל הארץ אשר נתן להם ה'”. חז”ל מסבירים שמשה חשש שבני גד ובני ראובן רוצים לדאוג רק לחיים החומריים שלהם, ולכן בתוכחה שלו אליהם הוא כל הזמן הזכיר את הקב”ה שנתן לנו את הארץ. למשה רבנו הייתה מטרה לרשת את ארץ ישראל במלחמת התקפה, כדי שנהיה כאן ממלכת כהנים וגוי קדוש. זו הייתה התוכחה שלו לבני גד ובני ראובן. אחרי שהם יצאו למלחמה וניצחו, הם חזרו לעבר הירדן לרעות צאן ולשבת ללמוד תורה. צריך לומר ל”פורום מטכ”ל”: העם רוצה לנצח, ניצחון מוחלט, בזמן שחלקכם ישנתם הוא יצא לקרב, “האחיכם יבואו למלחמה ואתם תשבו פה”? עם הקונספציות שלכם? איך אפשר לנצח ככה?

לצד ההירתמות והגיוס למלחמה, האזרחים חייבים לשאול מה המטרה של ראשי צה”ל במלחמה הזאת שלמענה הם רוצים לגייס את החרדים, וגם את הדתיים (שצריכים לשאול את השאלות האלו). האם המטרה היא לחסל את היכולות המבצעיות של חמאס ולתת את עזה לאבו מאזן? בשביל זה הלוחמים מוסרים את הנפש? לשמור באיו”ש ולהשאיר מאות אלפי נשקים (צה”ליים) בידי הרשות הפלשתינית? האם הערכים הם ניצחון והכרעה, או הכלה ושלום? כוח אדם זהו צורך חשוב במלחמה, אבל מי שמגייס צריך לענות אם המטרה היא מיגור הטרור או הכלתו. בד בבד ייערך גיוס החרדים.

כל החרדים המגויסים לא חייבים ללכת לקרבי, אפשר גם לארגן להם תוכניות השמה ב־8200, חיל חינוך, הרבנות הצבאית, גל”צ ויוהל”ם.

אני בעד גיוס חרדים, גיוס דתיים, וגם גיוס חילונים (מומלץ לבדוק לא פחות את שיעורי הגיוס לקרבי בצפון תל אביב). אבל לפני סוגיית בניין הכוח וההון האנושי, חייבים לטפל בסוגיית בניין המוח; יש להחליף במיידי את כל אלופי הקונספציה ולחזק את ערך הניצחון – זה צריך להיות סדר היום הציבורי של מדינה חפצת חיים. אחרי שערכי הניצחון והשמדת האויב יתבררו, נבדוק כמה כוח אדם באמת נצרך, ונתחיל לגייס את החרדים שאינם לומדים בצורה מסודרת, בהתאמה לאורח חייהם, ולא בקמפיין שכולו פוליטי וציני, שגורם להם להתבצר בעמדותיהם.

הרי רק לפני הטבח שר הביטחון גלנט והרמטכ”ל הרצי הלוי לא יצאו נגד הסרבנות של מחאת קפלן, כי טענו שזה יעודד עוד יותר סרבנות. מול השמאל הרדיקלי הם עובדים בכפפות של משי, ומול החרדים בכפייה? הצביעות זועקת לשמיים.

לכן השלבים צריכים להיות לפי הסדר: הקמת ועדת חקירה עכשיו, הדחת האלופים האחראים למחדל, קביעת מטרות ברורות וגיוס לצבא של כולם בתהליך מתואם ומדורג. בלי שטיקים ובלי טריקים שנועדו להסיח את הדעת.
