I arrived at the office and saw what looked like a pretty(4) piece of cake on the table. Then, I put my heart(5) that someone was working on me(6). It was not cake at all! It was just a plastic blob that others wanted me to think was cake. Just then, Dave walked in and looked at my face and said “plaiiiiin!”(7) At first, I was angry on him but after a few minutes, I commented: “Biiiig! (8) You really worked on me! (9) Waste of time!” (10)

After that first, disappointing incident, I decided to flow(11) and see if I could also work on someone. And I knew exactly who I would work on: Yonatan! After all, he truly lives in a movie (12)and will not have any idea what I was up to.

FBI Raids of Safe Deposit Boxes

International Man: Recently, the FBI raided 700 safe deposit boxes in Beverly Hills.

They opened and searched through the content of every single box, regardless of whether there was any probable cause that individual box owners had committed any crime.

The FBI then attempted to confiscate anything worth more than $5,000 through civil asset forfeiture proceedings. Again, this was regardless of whether there was any evidence of wrongdoing by the individual box owners.

What do you make of this story?

Doug Casey: This is another of many indications that the FBI is totally corrupt and out of control. There’s no indication the agent-in-charge was even reprimanded, much less fired. It’s just one agency, but the fifteen other Praetorian agencies are no better.

An even bigger problem is that the rule of law itself is dead. At this point, almost any federal agency can do whatever they want. If you don’t like it and want to fight them, it’s going to cost a ton of legal fees.

The federal government is now controlled by actual Jacobins. They’re inclined to engage in lawfare against citizens—especially those who don’t share their views.

What’s in it for them? When they perform a civil asset forfeiture, a certain percentage goes to the agency that does it.

That money can buy cop toys and training to pad their resumes. That gives them a personal incentive to do things that are, in fact, criminal. It’s a very serious matter. It’s only going to get worse when CBDCs are initiated—they’ll make civil asset forfeitures, fines, and asset freezes much easier when all your money is visible and available at the central bank. It’s one more reason to own gold—but not store it in a US safe deposit box.

Think about greed and racial discrimination. In 1947, when the Brooklyn Dodgers hired Jackie Robinson, why did racial discrimination by major league teams begin to drop like a hot potato? It wasn’t feelings of guilt by white owners, affirmative action or anti-discrimination laws. It turned out that there was a huge pool of black baseball talent in the Negro leagues. It became too costly for teams to allow the Dodgers to gain a monopoly on this talent. Black players won the National League’s Most Valuable Player award for seven consecutive seasons. Had other teams not stepped in to hire black players, allowing the Dodgers to hire them, it might have given the Dodgers a virtual monopoly on world championships.

During South Africa’s apartheid era, whites were in control, both economically and politically, and enacted some of the harshest racially discriminatory employment laws. There were job reservation laws that reserved certain jobs for whites only. Many white employers went to considerable lengths to contravene and violate those laws. White building trade unions complained to the South African government that laws reserving skilled jobs for whites had broken down.

What was happening? White contractors found out that often they could earn greater profits by hiring a black worker to do the job of a white worker for only a fraction of the wage. That raised the cost of discriminating against black workers. Racist white workers did what any good liberal or labor union supporter would do; they got behind support for minimum wage laws and what produces the same effect, equal-pay-for-equal-work laws. South Africa’s Wage Board said, “The method would be to fix a minimum rate for an occupation or craft so high that no Native would likely be employed.” “Equal pay for equal work” became the rallying slogan of the South African white labor movement. They knew that if employers were forced to pay black workers the same wages as white workers, there’d be reduced incentive to hire blacks.

The Pay Gap Myth and Other Lies That Won’t Die

Rigorous research demonstrates that pay levels are determined by career decisions, not by the prejudices of employers.

We expect to hear a lot of lies during an election year, and this year is certainly no exception. What is surprising is how old some of these lies are, and how often they have been shown to be lies, years ago or even decades ago.

One of the oldest of these lies is that women are paid less than men for doing the same work. Like many other politically successful lies, it contains just enough of the truth to fool the gullible.

Women as a group do get paid less than men as a group. But not for doing the same work. Women average fewer annual hours of work than men. They work continuously for fewer years than men, since only women get pregnant, and most women are not prepared to instantly dump the baby on somebody else to raise.

Being a mother is not an incidental sideline, and being a single mother can be a major restriction on how much time can be put into a job, either in a year or over the years.

People like Hillary Clinton can simply grab a statistic about male–female income differences and run with it, since her purpose is not truth but votes. The real question, however, is whether, or to what extent, those income differences are due to employers paying women and men different wages for doing the very same jobs, for the very same amount of time.

We do not need to guess about such things. Many studies have been done over many years — and they repeatedly show that women and men who work the very same hours in the very same jobs at the very same levels of skill and experience do not have the pay gaps that people like Hillary Clinton loudly denounce.

As far back as 1971, single women in their thirties who had worked continuously since high school earned slightly more than men of the same description. As far back as 1969, academic women who had never married earned more than academic men who had never married.

People who are looking for grievances are not going to be stopped by facts, especially if they are in politics. But where are our media pundits and our academic scholars? Mostly silent, either out of fear of being denounced as anti-women or because they have chosen to take sides rather than convey facts.

Nevertheless, there are enough scholars, including women economists, who have done enough honest studies over the years that there is no excuse for continuing to repeat a discredited lie, based on comparing apples and oranges. A book written by two women and titled Women’s Figures shows the results when you compare women and men with comparable qualifications.

It is much the same story with black–white comparisons. More than 40 years ago, my own research turned up statistics on black and white professors who had Ph.D.s from equally high-ranked institutions in the same fields, and who had published the same number of articles.

When all these things were held constant, the black professors earned somewhat more than white professors. But, since all these things are not the same among black and white professors in general, there is a racial gap in pay that allows some to loudly denounce racial discrimination among academics.

ההנחה המקובלת על הכול היא שאי אז, לאחר תום המלחמה, תוקם ועדה שתחקור את כל הכשלים שהביאו לטבח הנורא שאירע ביישובי עוטף עזה בשמחת תורה האחרון. מהלך זה הוא הכרחי ומתבקש לשם הפקת לקחים יסודית וכדי לדאוג לכך שמחדל חמור שכזה לא יישנה. על בסיס זה מתקבעת בציבור הנחה נוספת, והיא שכל מי שיש לו יד ורגל במחדל יודח לאלתר מתפקידו. בדברים הבאים לא אעסוק ביתרונות ובמחירים שיש לגישה זו ברמה המעשית או הפוליטית, אלא במה שאנו יכולים ללמוד מן ההנהגה האלוקית וההלכתית באירועים שונים של כשל. את הדיון התורני נחלק לשניים, חלקו האחד יעסוק במי שנכשל והביא למפלה צבאית וחלקו השני במי שחטא.

הכישלון במלחמת העי

לא מצאנו בתנ”ך דוגמאות רבות למנהיג שנכשל בתפקידו. יש בתהילים כמה פרקים שבהם מתוארות מפלות צבאיות קשות (כמו פרקים ס-עט ופרק פ). בכולם תולה המשורר את המפלה בהנהגת ה’, וגם בפרק ס, העוסק במפורש במפלה קשה שהייתה בימי דוד, לא שמענו שהמלך הודח עקב כך ממלכותו או הדיח את יואב שר הצבא בשל כך. לאורך ספר מלכים מובאים כמה וכמה כישלונות צבאיים ומדיניים ואף אחד מהם לא הביא לסיום תפקידו של המלך, אם לא נהרג במלחמה. אולם מאחר שהסיבות לכישלונות אלה לא פורטו בכתובים, קשה מאוד ללמוד מהם.

מקרה אחד מסופר בהרחבה בתנ”ך, והוא המפלה בספר יהושע (פרק ז): “וישלח יהושע אנשים מיריחו העיי… ויעלו האנשים וירגלו את העיי. וישובו אל יהושע ויאמרו אליו: אל יעל כל העם… כשלושת אלפים איש יעלו ויכו את העיי אל תייגע שמה את כל העם כי מעט המה. ויעלו מן העם שמה… וינוסו לפני אנשי העיי”. אין ספק שהיה כאן כשל מודיעיני חמור שהביא למפלה קשה.

מסתבר שהדבר נבע מביטחון עצמי מופרז בעקבות הניצחון הניסי ביריחו. אולם היו כשלים נוספים, שעליהם ניתן לעמוד מתוך התיאור של ההתקפה השנייה (פרק ח): “ויקם יהושע וכל עם המלחמה לעלות העיי ויבחר יהושע… גיבורי החיל… וישלחם יהושע וילכו אל המארב… וילן יהושע בלילה ההוא בתוך העם… ויעל הוא וזקני ישראל לפני העם העיי… וילך יהושע בלילה ההוא בתוך העמק”.

מן ההבדלים בין הפרקים עולים הכשלים הבאים במערכה הראשונה: נשלחו כוחות מעטים מדי, לא הייתה תוכנית התקפה מסודרת, יהושע והזקנים נשארו בעורף ויהושע עצמו לא היה בשטח עם הלוחמים. על הנקודה האחרונה עמדו גם חז”ל: “‘קום לך’ (יהושע ז, י). לא כך אמר משה: ‘כי הוא יעבור לפני העם’ (דברים ג, כח) – אם יעבור עוברים, ואם לאו אין עוברים? ואתה שלחת (=את אנשי הצבא) ולא הלכת עמהם” (ילקוט שמעוני רמז יז).

סדרה כזאת של כישלונות, אילו הייתה בימינו, אין ספק שהייתה מעוררת תביעה חד־משמעית להדיח את יהושע או ציפייה שיודה ביוזמתו בכישלונו ויתפטר מתפקידו, ואם לא – לפחות שידיח את קציני המודיעין שלו.

תגובתו של יהושע שונה לחלוטין. הוא קורע את בגדיו, נופל לפני ארון ה’ ומתפלל עם זקני העם. הוא תולה את הכישלון בהנהגה האלוקית שאת פשרה אינו מבין. הקב”ה לא מעמיד אותו על הטעויות שעשה אלא מתמקד בשורש הרוחני של הכישלון: “קום לך! למה זה אתה נופל על פניך? חטא ישראל… וגם לקחו מן החרם… ולא יוכלו בני ישראל לקום לפני אויביהם עורף יפנו לפני אויביהם כי היו לחרם, לא אוסיף להיות עמכם אם לא תשמידו החרם מקרבכם”.

הכישלון הצבאי לא קרה מאליו. היה לו רקע רוחני שיצר את הגישה המוטעית שסימאה את העיניים מלראות את המציאות בעיניים פקוחות. ציפייה לעזרה מן השמיים כאשר העם נגוע בחטא אינה אלא ביטחון עצמי מופרז. החטא הזה לא יכול להיות מיוחס רק לאדם הבודד, וסקילת החוטא באבנים לא תביא לתיקון המיוחל. כל העם אחראי לחטא הזה, ולכן העם כולו שילם את המחיר. זה לא נובע רק מן הערבות ההדדית שבין כל חלקי העם, אלא מפני שחטאו של עכן מעיד על התרופפות מוסרית בעם כולו. כך אמרו חז”ל: ‘ושמתי אני את פניי באיש ההוא ובמשפחתו’ (ויקרא כ, ה)… אמר ר’ שמעון: אם הוא חטא, משפחתו מה חוטאת? לומר לך: אין לך משפחה שיש בה מוכס שאין כולה מוכסין, ושיש בה לסטים שאין כולה לסטים, מפני שמחפין עליו” (שבועות לט, א).

מן הסיבה הזאת נצטווה יהושע להפיל גורלות במעגלים הולכים ומצטמצמים עד שהמעגל נסגר על עכן. ההבנה היא שחטאו של היחיד אינו צומח בחלל ריק אלא על רקע תרבותי מקולקל, לכן לא די למצוא את האשמים. התיקון הנדרש מכוון אל התרבות החברתית שהצמיחה אותו מתוכה. יש להניח ששורשו של חטא המעילה בחרם הוא התייחסות חומרנית לארץ ישראל מתוך התנכרות לקדושתה ולייעוד הגדול הכרוך בהיאחזות בה.

לאחר טיפול השורש מגיע הזמן לטפל בטעויות של יהושע, שנבעו באופן סמוי מן החטא הזה עצמו וגם השפיעו עליו. נחזור לדברי הילקוט שמעוני: “מה תלמוד לומר ‘קום לך’? אמר לו (=הקב”ה ליהושע): אתה גרמת להם (=בכך שהטלת חרם על יריחו). והיינו דקאמר ליה בעיי: “ועשית לעיי ולמלכה כאשר עשית ליריחו ולמלכה, רק שללה ובהמתה תבוזו לכם”.

טעות זו של יהושע קשורה לטעות האחרת שלו, בכך שלא עמד בראש הצבא ולא שהה עם החיילים בשטח. יהושע תבע מן העם לעמוד ברף ערכי גבוה שלא כולם היו מסוגלים לעמוד בו. הנתק הרוחני בין המנהיג לעם הוא זה שזימן את החטא ואת המפלה. יהושע לומד בדרך הקשה את דרכה של המנהיגות בישראל, להיות “בתוך העם” ואף לרדת ולהיות “בתוך העמק” ולהוביל את העם מתוך חיבור והכרה מעמיקה של מצבו ושל חולשותיו. תובנה עמוקה זו מחלחלת אצלו כבר בשיחתו עם עכן לאחר שנלכד, כשהוא קורא לו “בני”. יהושע לא מפוטר, לא מתפטר ולא מפטר איש. הוא מבין לעומק את גורמי הכישלון ולומד לנהוג ולהנהיג בדרך שונה לחלוטין, שמובילה אותו לשורה ארוכה של ניצחונות בדרך לכיבוש הארץ.

בעל תפקיד שחטא

עד כאן עסקנו במי שלא עבר עבירה אלא טעה ונכשל. מה אומרת לנו התורה על מי שחטא?

ההיבט ההלכתי של נושא זה נדון בהרחבה בספר ‘שולחן מלכים’ על הלכות מלכים של הרמב”ם (בהוצאת מרכז תורה ומדינה), פרק א, הלכה ז. עולה משם תמונה מורכבת, כאשר הדין משתנה בין תפקידים שונים וחטאים שונים. כהן גדול שעבר עבירה שיש בה מלקות – לוקה וחוזר לתפקידו. לעומת זאת ראש ישיבה (שהוא גם דיין ופוסק הלכות) מודח מתפקידו לחלוטין (רמב”ם הלכות סנהדרין, פרק יז, הלכות ח-ט). נשיא בית המשפט שעבר עבירה פלילית לא יכול להיות שופט. על בעל תפקיד ציבורי שרצח בשגגה כותב הרמב”ם ש”הרי הוא מורד מגדולתו כל ימיו הואיל ובאה תקלה זו הגדולה על ידו” (הלכות רוצח, פרק ז, הלכה יד). על שלמה המלך נאמר שנדחה מן המלכות לאחר שהרשה לעצמו לשאת נשים רבות בניגוד לציווי בתורה (גיטין סח, ב). המהר”ל מבאר שאין לראות בזה חטא רגיל אלא “שהיה דוחה התורה” (תפארת ישראל פרק מט). דהיינו, לא בשל המעשה עצמו אלא בשל הרקע התודעתי שלו, שהיה חמור במיוחד.

דיון נפרד ישנו במי שחטא וחזר בתשובה. על דוד המלך נמתחה ביקורת חריפה בשל מעשה בת שבע, אולם הוא לקח אחריות מלאה על מעשיו ולא האשים נסיבות כאלה ואחרות. משום כך, אף שנענש בחומרה לא הודח מתפקידו אלא נחשב כמי ש”הקים עולה של תשובה” (עבודה זרה ה, א). הרמב”ם כותב (שו”ת סימן קעג) שלא די בתשובה של בעל התפקיד בינו לבין עצמו. עליו לחזור בתשובה ברמה כזאת ש”נתפרסם תשובתו לרבים” ולהוכיח בהתנהגות עקבית את התרחקותו המוחלטת מן החטא (עיין רמב”ם, הלכות עדות, פרק יב).

עם זאת מצאנו בעלי תפקידים שהודחו למרות שחזרו בתשובה. כך היה אצל ראובן, שאף שעל פי המדרש חזר בתשובה שלמה על מעשה בלהה הודח מן הבכורה (בראשית מט, ג-ד; דברי הימים א’ ה, א), וזאת בגלל שהחטא חשף תכונת אופי בסיסית שאינה מתאימה להנהגה (אברבנאל, רש”ר הירש). כך היה גם אצל שאול המלך (שמואל א’ פרק יג ופרק טו), שהאשים את העם בחטאיו ולא לקח עליהם אחריות מלאה. לעומת זאת על יהודה, שנכשל גם במכירת יוסף וגם במעשה תמר, אבל במהלך הזמן לקח על כך אחריות מלאה ופעל לתיקון גם תוך נכונות לשלם מחיר אישי גבוה, אמר יעקב “לא יסור שבט מיהודה ומחוקק מבין רגליו” (בראשית מט, י).

סוף דבר, השאלה אם להדיח מתפקידו את מי שכשל איננה שאלה של ענישה על העבר. אמת המידה שעל פיה נכון לפעול צריכה להיגזר מתוך השאיפה ליצור עתיד טוב ומתוקן יותר.
