מהו פתח בנדר?

משנה נדרים ט’ ה’, פותחין לו לאדם בכתבת אשתו. ומעשה באחד שנדר מאשתו הנאה והיתה כתבתה ארבע מאות דינרין, ובא לפני רבי עקיבא וחייבו לתן לה כתבתה. אמר לו, רבי, שמנה מאות דינרין הניח אבא, ונטל אחי ארבע מאות ואני ארבע מאות, לא דיה שתטול היא מאתים, ואני מאתים. אמר לו רבי עקיבא, כו’. אמר לו, אלו הייתי יודע שהוא כן, לא הייתי נודר, והתירה ר”ע. וכן שם ט’, שלמחר אומרין עליך כך היא וסתו של פלוני, מגרש את נשיו, ועל בנותיך יהיו אומרין בנות גרושות הן, מה ראתה כו’. וק”ל, הא לשון חכמים לשון קצרה? וי”ל, שלא התיר ר”ע אלא בעם הארץ גמור, ולא דמי ליין ובצל שיש גם יפים, וכן להלן. מקופיא.

Status Quo Bias: a Definition

This site is depicted as discussing, among other things, Status Quo Bias. For those who don’t know, allow me to explain:

Just because a certain behavior is common, even among the many, does not grant it legitimacy. There have frequently been various popular sins in various periods. Yes, Minhag has weight, but it doesn’t automatically outweigh all other calculations.

Again, SQB does not refer to the idea that a given custom has always been customary. And SQB isn’t overlooking change; that’s called Normalcy bias. It is the fallacy of appealing to the way things are, claiming they ought to stay the same for an insufficient reason.
